<p>In testimony before a U.S. Senate panel last week, Homeland Security Secretary Janet Napolitano said northern border surveillance using unmanned aerial aircraft now expands from North Dakota to Eastern Washington.</p>

<p>Today is May Day. Since 2007, I have been commemorating this day here at the Volokh Conspiracy as Victims of Communism Day. Various other websites and blogs have&nbsp;<a rel="nofollow" href="http://distributedrepublic.net/archiv ... mbrance">promoted the same concept</a>. In time, we hope to make this a worldwide commemoration similar to&nbsp;<a rel="nofollow" href="http://en.wikipedia.org/wiki/Holocaus ... l_Days">Holocaust Memorial Day</a>. We appropriately have a Holocaust Memorial Day. It is equally appropriate to commemorate the victims of the twentieth century’s other great totalitarian tyranny. And May Day is the most fitting day to do so. I suggest that May Day be turned into Victims of Communism Day….</p>
<p>The main alternative to May 1 is November 7, the anniversary of the communist coup in Russia. However, choosing that date might be interpreted as focusing exclusively on the Soviet Union, while ignoring the equally horrendous communist mass murders in&nbsp;<a rel="nofollow" href="http://www.hawaii.edu/powerkills/COM.ART.HTM">China, Camobodia, and elsewhere</a>. So May 1 is the best choice.</p>

<p>Since I wrote that post,<a rel="nofollow" href="http://volokh.com/2010/12/17/frank-di ... t;>&nbsp;historian Frank Dikotter&nbsp;</a>has unearthed new evidence solidifying China’s status as the communist regime with the most extensive record of mass murder. This makes it all the more preferable to choose an international rather than Russia-centric date for Victims of Communism Day.</p>

<p>Back in 2009, I sought to explain&nbsp;<a rel="nofollow" href="http://volokh.com/2009/11/08/why-the- ... ters/">“Why the Neglect of Communist Crimes Matters.”&nbsp;</a>In&nbsp;<a rel="nofollow" href="http://volokh.com/2010/11/23/did-jose ... t-genocide/">this post</a>, I discussed the contentious question of whether various Soviet atrocities qualify as genocide. It is likely that only a minority of communist crimes fall under the current legal definition of genocide. The lion’s share are examples of “mere” mass murder. However, for reasons I explain&nbsp;<a rel="nofollow" href="http://volokh.com/archives/archive_20 ... p;nbsp;and&nbsp;<a rel="nofollow" href="http://volokh.com/archives/archive_20 ... 9">here</a>, I don’t think this distinction carries any significant moral weight.</p>

<p>The evil inside the White House operative, <strong><a rel="nofollow" href="http://www.economicpolicyjournal.com/ ... l-hard.html">Cass Sunstein</a></strong>, is out this morning with a <a rel="nofollow" href="http://online.wsj.com/article/SB10001 ... TopOpinion">short essay</a> in WSJ.</p>
<p>Under the guise of filling us all in on what his White House department is doing to “clear away red tape”, the evil bastard is really informing his followers about the advancements in one world government and a North American union:</p>

<p>In an interdependent global economy, diverse regulations can cause trouble for companies doing business across national boundaries. Unnecessary differences in countries’ regulatory requirements can cost money, compromising economic growth and job creation. Think of divergent requirements for car headlights, or the labeling of food, or standards for container sizes.</p>
<p>Recognizing this, President Obama’s Jobs Council has called for U.S. agencies to better align U.S. regulations with those of our major trading partners. And today the president is issuing an executive order, “Promoting International Regulatory Cooperation,” with a simple goal: to promote exports, growth, and job creation by eliminating unnecessary regulatory differences across nations.</p>
<p>The order makes clear that we will not undermine American laws or compromise our national prerogatives. But it emphasizes that international cooperation and harmonization can increase trade and job creation, eliminating pointless burdens without creating a regulatory race to the bottom. From now on, an interagency working group chaired by the White House Office of Information and Regulatory Affairs [Note; Sunstein chairs this agency-RW] will be a forum for reducing this red tape.</p>

<p>Here’s the advancing of the North American union:</p>

<p>More generally, President Obama has worked closely with his Canadian and Mexican counterparts to create High-Level Regulatory Cooperation Councils with both countries. The councils are developing and implementing plans to eliminate or prevent the creation of unnecessary burdens on cross-border trade, streamline regulatory requirements, and promote greater certainty for the general public and for businesses in the regulation of food, pharmaceuticals, nanotechnology and other areas.</p>
<p>The U.S. and Canada have already agreed to harmonize their rules with respect to fuel economy, building on a long history of collaboration on national emission standards for new vehicles. This step will avoid divergent requirements and unnecessary costs on both automobile companies and consumers.</p>

<p>Here’s the advance of the One World government:</p>

<p>The U.S. is also working closely with the European Union to eliminate unnecessary differences in U.S.-European regulatory requirements. Last February, the Obama administration announced an agreement with the EU under which organic products certified as such in Europe or in the U.S. may be sold as “organic” in either jurisdiction. This is not just a victory for those who grow and eat organic broccoli. The trans-Atlantic partnership, involving the two largest organic food producers in the world, will help support jobs in the years to come.</p>
<p>Whether the issue involves chemicals or vegetables, nations can do a far better job of harmonizing regulatory requirements to make it easier for companies to do business, and without sacrificing public health, safety and the environment. We hope that today’s executive order provides a new model for eliminating red tape and promoting trade and job creation. Let’s get to work.</p>

<p>A Tennessee man was charged and jailed by police Friday after he used an old $50 bill to pay for goods at a Quik Mart store.</p>
<p>“A clerk at Quik Mart, South Cannon Boulevard, notified police after the marker used to detect counterfeit bills didn’t check as real.” reports David Melson of the <a target="_blank" rel="nofollow" href="http://www.t-g.com/story/1843748.html ... <strong>Shelbyville Times-Gazette</strong></a>.</p>
<p>“The front side of the bill was off center and it didn’t feel like a normal bill, it did look to be counterfeit,” officer Brock Horner said in his report.</p>
<p>The man, Lorenzo Gaspar was taken to jail by the officer, but was released after a sergeant noted that old bill are still legitimate legal tender but do not “check” with modern cash markers.</p>
<p>Two separate banks declared the bill to be real after studying it. Mr Gaspar was released from jail with an apology and told to change the note for a newer traceable one.</p>
<p>It’s a good job Mr Gaspar wasn’t caught using gold or silver as a form of currency, despite the US Constitution declaring that the precious metals are legal tender, <a target="_blank" rel="nofollow" href="http://www.zerohedge.com/article/trad ... uot;><strong>the feds</strong></a> consider it <a target="_blank" rel="nofollow" href="http://www.infowars.com/federal-gover ... "><strong>a heinous crime</strong></a> punishable by jail time.</p>

<p>As a federal court prepares to rule on a challenge to Sirhan Sirhan’s conviction in the Robert F. Kennedy assassination, a long overlooked witness to the murder is telling her story: She heard two guns firing during the 1968 shooting and authorities altered her account of the crime.</p>
<p>Nina Rhodes-Hughes wants the world to know that, despite what history says, Sirhan was not the only gunman firing shots when Kennedy was murdered a few feet away from her at a Los Angeles hotel.</p>
<p>“What has to come out is that there was another shooter to my right,” Rhodes-Hughes said in an exclusive interview with CNN. “The truth has got to be told. No more cover-ups.”</p>

<p>During a rare public appearance, the Obama Administration’s Information Czar Cass Sunstein told a crowd gathered at the NYU Law School in NYC yesterday that he has little recollection of writing a 2008 paper that called for a ban on conspiracy theorizing.</p>
<p>In the question and answer portion of the lecture, <em>We Are Change</em> founder Luke Rudkowski confronted Sunstein concerning his avocation of a “provocateur” style program to silence what have become the government’s most vociferous and influential critics.</p>
<p>With tongue firmly in cheek, Rudkowski introduced himself as “Bill de Berg from Brooklyn college,” before directly asking Sunstein to explain his comments.</p>
<p>“I know you wrote many articles, but I think the most telling one about you is the 2008 one called ‘Conspiracy Theories,’ where you openly advocated government agents infiltrating activist groups for 9/11 truth, and also to stifle dissent online,” Rudkowski stated.</p>
<p>“Why do you think the government should go after family members and responders who have questions about 9/11?” he asked Sunstein.</p>
<p>“I’ve written hundreds of articles and I remember some and not others,” Sunstein replied, denying that he has a firm recollection of the paper.</p>
<p>“I hope I didn’t say that, but whatever was said in that article, my role in government is to oversee federal rulemaking in a way that is wholly disconnected from the vast majority of my academic writing, including that,” Sunstein added.</p>
<p>“I know that, I’m just asking because you may be the next Supreme Court Justice if Obama appoints you, and you did write those things,” Rudkowski replied.</p>
<p>“I may agree with some of the things I have written but I’m not exactly sure. I focus on what my boss wants me to do,” Sunstein said, intimating that he was just following orders.</p>
<p>When Rudkowski asked if Sunstein would retract his comments about banning opinions that differ from those of the government, Sunstein again claimed he did not remember the article he had written and his personnel intervened to prevent Rudkowski pressing him on the matter.</p>

<p>Within his infamous paper, which can be downloaded&nbsp;<strong><a target="_blank" rel="nofollow" href="http://ssrn.com/abstract=1084585">here</a>, </strong>Sunstein outlined plans for the government to infiltrate “conspiracy groups,” including the 9/11 Truth Movement, in order to undermine them via postings on chat rooms and social networks, as well as real meetings.</p>
<p>The specifics of the plans must be read in full in order to gauge their extreme nature and the threat Sunstein poses to the freedom in America.</p>
<p>On page 14 of &nbsp;the paper, he proposed that “under imaginable conditions” the government “might ban conspiracy theorizing” and could “impose some kind of tax, financial or otherwise, on those who disseminate such theories.”</p>
<p>In effect, Obama’s information czar called for taxing or banning outright, as in making illegal, opinions and ideas that the government doesn’t approve of.</p>
<p>Sunstein’s definition of a “conspiracy theorist” encompasses those who question manmade global warming and, most bizarrely, anyone who believes that sunlight is healthy for their bodies.</p>
<p>Presumably if Sunstein had been in power in the latter middle ages he would have attempted to tax and then ban the work of Galileo Galilei for subscribing to the theory that the Earth was not the centre of the universe and that it actually revolved around the Sun.</p>
<p>When he’s not going after those evil sunlight lovers, Sunstein&nbsp;<strong><a target="_blank" rel="nofollow" href="http://www.americanthinker.com/blog/2 ... a.html">advocates Internet censorship</a></strong> via enforced and regulated links in news pieces to opposing opinions.</p>
<p>Sunstein himself later retracted that proposal, explaining that it would be “too difficult to regulate [the Internet] in a way that would respond to those concerns,” and admitting that it was “almost certainly unconstitutional.”</p>
<p>Sunstein has also called for the re-writing of the First Amendment, and has even proposed a mandatory celebration of&nbsp;<strong><a target="_blank" rel="nofollow" href="http://en.wikipedia.org/wiki/Cass_Sunstein#Taxation">tax day in America.</a></strong></p>
<p>His views on the Second Amendment have also raised serious concerns. In his book “Radicals in Robes,” he wrote: “[A]lmost all gun control legislation is constitutionally fine.”</p>
<p>Sunstein is on record attacking the Second Amendment. Watch in the following clip as he says “The Supreme Court has never suggested that the Second Amendment protects the individual right to have guns.”</p>
<p>Given his extreme actions and stated intentions, Cass Sunstein should be forced out of office and barred from practicing law with immediate effect. If president Obama has his way, however, we may very soon see his good buddy Sunstein elevated to the highest judicial position in the country.</p>

<p>U.S. government has a history of dangerous biological testing on the American public</p>

<p>Despite the fact that the U.S. government has a history of dangerous biological testing against the American people, the Department of Homeland Security claims that a bacteria it plans to release in the Boston subway later this year to test biological sensors is harmless to healthy people.</p>
<p>“Federal officials say they test the subway sensors by releasing dead bacteria called B-subtilis. They say it is used in food supplements, has been rigorously tested and has no adverse health effects for low exposure in healthy people,” <a rel="nofollow" href="http://boston.cbslocal.com/2012/04/30 ... facebook">reports CBS News</a>.</p>
<p>What effect the tests will have on <em>unhealthy</em> people or those exposed to higher doses is unknown.</p>
<p>The tests will be held in Cambridge and Somerville during off peak hours this summer, but not before a hearing on May 16, from 5:30-7:30pm at the Cambridge YMCA in Central Square, during which the public will voice concerns and ask questions about the experiment.</p>
<p align="left">The bacteria will be released as a means of testing biological sensors that guard against the threat of a bio-terror attack. The DHS has released a 28-page summary entitled ‘Environmental Assessment for Bacillus subtilis Particles to Challenge Bio-Detection Sensors in Subway Stations’ (<a rel="nofollow" href="http://www.dhs.gov/xlibrary/assets/st ... df">PDF</a>).</p>
<p align="left">Given the federal government’s ominous record in releasing biological agents into subway systems and other transport hubs, it’s no surprise that this latest example is sure to cause consternation, which is probably why the feds are being so open about it.</p>
<p align="left">During a Senate hearing in 1977, it was revealed that the Pentagon had conducted numerous secret germ “attacks” on cities without public knowledge in an effort to test the threat posed by biological agents. These tests “may have caused outbreaks of disease which occurred in some of the test areas,” <a rel="nofollow" href="http://findarticles.com/p/articles/mi ... _3838424/">writes Leonard A. Cole</a>, citing the Senate inquiry.</p>
<p align="left">These “attacks” included a 1964-65 program carried out by the U.S. Army which involved unsuspecting travelers being sprayed with bacteria-laden mist at Washington’s National Airport.</p>
<p align="left">Another example involved light bulbs containing Bacillus globigii that were dropped in the New York Subway by government scientists and allowed to contaminate the air. Similar tests were also conducted in the Chicago subway system, but when people started falling ill the connection with the tests was fudged because the government refused to keep track of the health effects of the released substance.</p>
<p align="left"><a rel="nofollow" href="http://news.bbc.co.uk/1/hi/programmes ... /4701196.stm">The hidden U.S. history of germ testing</a> in general also serves as a warning that allowing the government to experiment with biological agents in public which it claims are perfectly safe has not always been a wise choice.</p>
<p align="left"><a rel="nofollow" href="http://www.projectshad.org/">Project SHAD</a>, a Cold War-era Department of Defense program in which veterans were exposed to deadly chemical weapons without their knowledge or consent, also represents a dark chapter in the U.S. government’s use of dangerous biological agents against its own people.</p>
<p align="left">Since the 1940′s, the military and the CIA have conducted numerous “tests” on the American people, including the release of dengue fever carrying mosquitoes in Georgia and Florida, biological warfare tests on the civilian population in Puerto Rico, the release of bacillus globigii from a submarine on the port of Oahu, Hawaii, and dozens of other incidents, most of them classified.</p>
<p align="left">The history of <a rel="nofollow" href="http://en.wikipedia.org/wiki/Unethica ... nited_States">U.S. government and military experimentation on American citizens</a> and the innumerable deaths and illnesses that occurred as a result underscore the fact that trusting the Department of Homeland Security, which has proven itself to be one of the most corrupt and secretive federal agencies in existence, to carry out such tests in public, no matter how “safe” the DHS claims them to be, is the height of stupidity.</p>
<p align="left">Indeed, the DHS also claims its naked body scanning machines are “safe” <a rel="nofollow" href="http://www.prisonplanet.com/tsa-to-te ... ure.html">despite being linked with cancer by numerous health authorities</a>, and refuses to allow them to be independently tested, so why on earth should the federal agency be believed when it claims the bacteria it plans to release is harmless?</p>

<p><strong><font color="#FF0000">If Transportation Security pat downs at public venues, thousands of drones over the skies of America, and the National Security Agency’s new Echelon-like listening center in Utah weren’t enough to convince you that we’re living in a police state, then perhaps the latest news out of Chicago will change your mind.</font></strong></p>
<p>As world leaders prepare to meet in the windy city for their annual <strong><font color="#FF0000"> NATO summit,</font></strong> U.S. federal officials are working feverishly to implement a security net so broad that it encompasses the entirety of Cook County, Illinois. While international summits are traditionally met with a larger police presence and preparations for the possibility of protests or rioting, what’s taking place on American soil in anticipation of the May 20 meeting in downtown Chicago can be interpreted in only one way – the implementation of regionalized martial law.</p>
<p>Last week Red Cross officials reported that the City of Chicago, Department of Homeland Security and the Secret Service had instructed them to prepare for a mass evacuation of the city in the event of an emergency during the NATO summit. The Red Cross was to prepare to shelter and feed residents in the event of such an evacuation.</p>
<p>On the heels of that announcement, more details have emerged and they suggest the Federal security apparatus has completely lost &nbsp;its marbles.</p>

<p>The Illinois Department of Transportation is testing an emergency plan to&nbsp;<strong>shut off access into and out of downtown Chicago</strong>. The plan uses a network of highway security gates that are designed to shut down all traffic coming in and out of Chicago in the event of a terrorist attack.</p>
<p>The Illinois DOT is&nbsp;<a rel="nofollow" href="http://www.truckinginfo.com/news/news ... id=76779">warning truckers</a>&nbsp;that it’s best to avoid the city during the NATO Summit in Chicago May 20-21.&nbsp; There will be a number of driving restrictions and rolling street closures, and the Illinois DOT is testing highway barricades that will block access to all major highways in and out of Chicago.</p>
<p>These barricades, which started being installed on Chicago highways back in 2005, are deigned to restrict or cut off access to roads during an emergency like a bioterrorism attack.</p>
<p>…The Illinois DOT’s testing of these highway entrance ramp gates has many worried about the chaos that NATO may bring to Downtown Chicago. There is already talk about&nbsp;<a rel="nofollow" href="http://offgridsurvival.com/government ... cago/">widespread city wide evacuations</a>, rioting, terrorist attacks and even large scale detention centers and arrests.</p>

<p><strong>Detention Centers</strong></p>
<p>It’s been reported by the local media, that Cook County Sheriff Tom Dart is devising a strategy to deal with large-scale mass arrests during the NATO Summit meeting. In fact, the&nbsp;<a rel="nofollow" href="http://www.examiner.com/article/chica ... ilwaukee">Chicago Sun Times</a>&nbsp;is reporting that the once abandoned Joliet State Prison may be reopened as a mass detention center for NATO.</p>
<p>Joliet prison is about 40 miles from Chicago and can hold about 1,300 prisoners. The Sheriff is also reportedly looking at building tents in the yard at Cook County Jail.</p>
<p><strong>Militarized Red Zone</strong></p>
<p>Starting May 1st, a full three weeks before the NATO Summit, the Federal Government will be setting up a Militarized Red Zone in the streets of Downtown Chicago.</p>

<p>The news of federal agents on the streets of Chicago isn’t sitting well with many. From last months&nbsp;<a rel="nofollow" href="http://offgridsurvival.com/urbanwarfa ... wnchicago/">urban warfare drills</a>, to residents being&nbsp;<a rel="nofollow" href="http://offgridsurvival.com/government ... echicago/">warned of possible citywide evacuations</a>, the city of Chicago is starting to look like a city that may already be under martial law.</p>

<p>The human capacity for self-delusion truly is remarkable.&nbsp; Most people out there end up believing exactly what they want to believe even when the truth is staring them right in the face.&nbsp; Take the U.S. economy for example.&nbsp; Barack Obama wants to believe that his policies have worked and that the U.S. economy is improving.&nbsp; So that is what he is telling the American people.&nbsp; The mainstream media wants to believe that Barack Obama is a good president and that his policies make sense and so they are reporting that we are experiencing an economic recovery.&nbsp; A very large segment of the U.S. population still fully supports Barack Obama and they want to believe that the economy is getting better so they are buying the propaganda that the mainstream media is feeding them.&nbsp; But is the U.S. economy really improving?&nbsp; <strong><font color="#FF0000">The truth is that it is not.&nbsp; The rate of employment among working age Americans is exactly where it was two years ago and household incomes have actually gone down while Obama has been president.&nbsp; Home ownership levels and home prices continue to decline.&nbsp; Meanwhile, food and gasoline continue to become even more expensive.&nbsp; The percentage of Americans that are dependent on the government is at an all-time record high and the U.S. national debt has risen by more than 5 trillion dollars under Obama.&nbsp; We simply have not seen the type of economic recovery that we have seen after every other economic recession since World War II.</font></strong></p>

<p>We have never come close to recovering from the last recession and another one will be here soon.</p>

<p><strong><font color="#FF0000"><strong>#1</strong> The percentage of Americans that own homes is dropping rapidly.&nbsp; According to Gallup, the current level of homeownership in the United States&nbsp;<a target="_blank" rel="nofollow" href="http://www.gallup.com/poll/154124/U.S ... its-Decade-Low.aspx" title="is the lowest">is the lowest</a> that Gallup has ever measured.</font></strong></p>
<p><strong><font color="#FF0000"><strong>#2</strong> Home prices in the U.S. continue to fall like a rock as well.&nbsp; They have declined for six months in a row and are now down a total of&nbsp;<a target="_blank" rel="nofollow" href="http://finance.yahoo.com/news/us-home ... -6th-130235133.html" title="35 percent">35 percent</a> from the peak of the housing bubble.&nbsp; The last time that home prices in the United States were this low was back&nbsp;<a target="_blank" rel="nofollow" href="http://money.cnn.com/2012/04/24/real_ ... index.htm?hpt=hp_t1" title="in 2002">in 2002</a>.</font></strong></p>

<p><strong><font color="#FF0000"><strong>#24</strong> The Federal Reserve bought up approximately&nbsp;<a target="_blank" rel="nofollow" href="http://www.moneynews.com/Headline/fed ... 012/03/28/id/434106" title="61 percent">61 percent</a> of all government debt issued by the U.S. Treasury Department during 2011.</font></strong></p>

<p>But the horrible economic statistics only tell part of the story.</p>

Unemployed for three years, Joann has gone from making “$60,000 a year to less than $15,000 overnight.” Her husband is disabled and dependent on medicines the couple can no longer afford. They rely on food stamps, which, Joann says, “is depressing as hell.”</em></p>
<p><em>Receiving government aid, however, has not been as depressing as her job search. Joann says she has applied for at least 300 jobs. Even though she can barely afford gas, she drives to the interviews only to learn that the employers want to hire younger candidates at low wages.</em></p>
<p><em>The experiences have taken a toll: “I’ve aged 10 years in the three years that I’ve been looking for a job,” Joann told us. “I want to get a job so I can just relax and exhale … but I can’t. After a while you just give up.”</em></p>

<p>Meanwhile, Barack Obama and his family continue to live the high life at the expense of the U.S. taxpayer.</p>

<p>The United States military has deployed several F-22 fighter jets to an allied base less than 200 miles (320 km) from&nbsp;<a target="_blank" rel="nofollow" href="http://www.ynetnews.com/articles/0,7340,L-3284215,00.html">Iran</a>, Fox News reported Friday.</p>

<p>According to the report, the US Air Force strongly denied ordering the deployment in a show of force against Iran, or that it is in some way related to a potential strike on the Islamic Republic’s nuclear facilities. It claimed the measure is part of routine activity and “security cooperation with regional partners.”</p>
<p>“The United States Air Force has deployed F-22s to Southwest Asia,” Lt.Col. John Dorrian, Air Force public affairs, said in a written statement. “Such deployments strengthen military-to-military relationships, promote sovereign and regional security, improve combined tactical air operations, and enhance interoperability of forces, equipment and procedures.”</p>
<p>The Air Force refused to disclose how many jets were sent or exactly where they are stationed, but US officials have told Fox News the jets are in hangars at the United Arab Emirates’ Al Dafra Air Base.</p>
