Internet next target in 'anti-terror battle'

Using the internet to promote acts of terrorism will become a criminal offence under plans to be unveiled by the European Commission today.

The plan is designed to step up the anti-terrorism fight by criminalising anything on the web which amounts to training for terrorism or incitement to commit terrorist acts – including guides to assembling bombs and weapons.

The move came on the day British Prime Minister Gordon Brown was due to use his first Queen's Speech to unveil the Counter-Terrorism Bill to increase powers of detention and interrogation of suspected terrorist.

Yesterday the UK's MI5 Director-General Jonathan Evans warned that al-Qaida has begun methodically "grooming" children and young people to carry out terror attacks in Britain, and last week Communities Secretary Hazel Blears announced £70m (€100m) of funding to counter recruitment of the young by extremists, including in the "ungoverned space" of the internet.

Today's EU proposal, which will need approval of EU governments before becoming law, warns that the web is "one of the principal boosters of the processes of radicalisation and recruitment".

It describes the internet as a "virtual training camp" for terrorist recruiters and "an ideal complement to off-line indoctrination and training".

EU Justice Commissioner Franco Frattini wants a new EU offence of "public provocation to commit a terrorist offence", which would include "the distribution, or otherwise making available, of a message to the public, with the intent to incite" acts of terrorism.

The offence would carry an agreed minimum jail term in all EU countries, and charges under the new law could be brought even if no act of terrorism resulted from the "public provocation".

The proposal states: "For an act to be punishable, it shall not be necessary that a terrorist offence be actually committed".

Although the internet is the prime target, the new law would apply to all communication deemed to provoke terrorism.

Commission officials insisted the law would not curb the use of the internet to express political, academic or analytical views on terrorism.

Today's plan includes other anti-terror measures, including airline passenger list databases across Europe – similar to the controversial data already demanded by Washington on transatlantic flights – and an explosives database, linking information across the EU on stolen explosives or on new terrorist methods for the use of explosives.

Liberal Democrat MEP Sarah Ludford said any new agreed anti-terror measures had to be subjected to "a rigorous test of necessity."

She went on: "It is not self-evident that piling on yet more layers of surveillance, profiling and criminalisation of conduct will pass that hurdle. Why not first tackle major existing failures like hoarding of essential information and non-implementation by some member states of the 2002 terrorism legislation?" introduced in the wake of the terror attacks on America on September 11 2001.)

Ms Ludford warned: "We also have to watch for function creep, where measures justified on grounds of fighting terrorism are usable against even petty crime."

The proposals also risked a repeat of the "familiar pattern" in which EU Governments "launder liberty-threatening laws through the EU but refuse EU competence for civil liberties and data protection safeguards".
